The objective of the Family Class of immigration is to reunite close family members in Canada.The Government of Canada has a strong commitment to keeping families together whenever possible. Because of this, processing of Family Class applications is a high priority at Canadian Visa Offices.
Canadian citizens or Permanent residents who are 18 years and older can sponsor a spouse or common-law partner who lives in Canada or outside Canada under the Spouse and Common-Law Partner including same-sex in Canada Class to live with them as permanent residents .
The sposnor must prove that he can meet basic needs—such as food, clothing and shelter—for his family, and support the spouse or common-law partner financially.
To be eligible for Immigration the Sponsored person :
- Must prove that he/she is legally married with Sponsor
- Must be at least 16 years old
Common-law partners must cohabit continuously for at least one year, excluding brief absences for business or family reasons.
Same-sex marriages performed within Canada are valid for spousal sponsorship. If the marriage took place outside of Canada, application can be made under the common-law partner or conjugal partner categories if such a relationship can be proven.
Spouses or Common-Law partners sponsored through the Family Class of immigration receive Canadian permanent residence. This includes the right to study and work in Canada. In 4 years of residence they can apply for Canadian citizenship.
